This Privacy Policy describes how Azar Capital Group LLC ("Azar Capital Group", "we", "us", or "our") collects, uses, and shares information about you when you visit azarcapitalgroup.com (the "Site") or submit a loan scenario or broker application through the Site (together, the "Services").

By using the Services or submitting information through any form on the Site, you agree to the collection, use, and disclosure of information in accordance with this Privacy Policy.

1. Who We Are

Azar Capital Group LLC is a private real estate lender providing financing secured by non-owner-occupied real estate. We do not provide financing for primary residences. The Services are directed at real estate investors, business entities, and real estate professionals; they are not directed to individuals under the age of 18.

2. Information We Collect

2.1 Information you submit

When you submit a loan scenario or broker application, we collect the information you provide in the form, which may include:

  • Your name, email address, and phone number
  • Your estimated FICO score
  • Company or brokerage name (brokers only)
  • Property address, property type, and details about the real estate transaction you are seeking to finance, including purchase price, appraised value, rehabilitation budget, rental income, and other financial particulars of the deal
  • Any additional information you voluntarily include

2.2 Information collected automatically

When you access the Site, we and our service providers may collect:

  • IP address, browser type and version, operating system, device identifiers, and referring URLs
  • Pages viewed, time spent on pages, and clicks within the Site
  • Date and time of your visit and the approximate geographic location derived from your IP address

We collect this information using server logs and standard web technologies. We do not currently use third-party advertising or marketing cookies. If we add such technologies in the future, we will update this Policy and, where required by law, obtain your consent.

2.3 Information from third parties

If you enter a property address, the Site's address autocomplete feature transmits what you type to a third-party geocoding provider to return address suggestions. We do not store the partial searches you type; only the address you ultimately select or enter is saved.

3. How We Use Your Information

We use the information we collect to:

  • Evaluate the loan scenario or broker inquiry you submit and contact you about it
  • Underwrite, structure, price, and issue term sheets for prospective loan transactions
  • Perform routine business operations, including customer-relationship management, record-keeping, fraud prevention, and internal audit
  • Comply with our legal and regulatory obligations
  • Secure, monitor, and improve the Site and investigate abuse or suspected misuse
  • Send transactional communications and, with your consent where required, occasional informational emails about our programs

4. How We Share Your Information

We share information only as described below:

  • Service providers. We use vetted third-party vendors to host the Site, operate our customer-relationship management system, relay form submissions, perform address autocomplete, deliver email, and provide similar operational services. These vendors are contractually obligated to use your information only to perform services on our behalf. Current categories include: cloud hosting, Salesforce (CRM), Zapier (workflow automation), and the geocoding provider used by the address autocomplete feature.
  • Capital and transaction partners. If you submit a loan scenario, we may share your information with title companies, appraisers, attorneys, underwriters, insurance providers, co-lenders, loan servicers, and capital partners to the extent necessary to evaluate, close, or service the prospective transaction.
  • Legal and safety. We may disclose information when we reasonably believe disclosure is required by law, subpoena, court order, or regulatory request, or when we believe disclosure is necessary to prevent fraud or protect our rights, property, or safety or that of others.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to customary confidentiality protections.

We do not sell your personal information and we do not share your personal information for cross-context behavioral advertising, as those terms are defined under applicable U.S. state privacy laws.

5. SMS/Text Messaging

If you provide your mobile number to Azar Capital Group, we may send you SMS text messages related to your loan inquiry or application, including status updates, document requests, payment and closing reminders, and occasional follow-ups about products you have inquired about.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are not shared with any third parties. Any information shared with the service providers and transaction partners described in the "How We Share Your Information" section is solely to operate our Services and to evaluate, close, or service a loan you requested, and never for their own marketing.

Message frequency varies based on your loan activity. Message and data rates may apply. You can reply STOP at any time to opt out, or HELP for assistance. Consent to receive text messages is not a condition of any loan or service.

6. Data Retention

We retain information you submit for as long as necessary to evaluate your inquiry, service any resulting loan transaction, comply with our legal and regulatory obligations (including audit, accounting, and anti-fraud requirements), resolve disputes, and enforce our agreements. Aggregated and de-identified data may be retained indefinitely.

7. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information against loss, misuse, and unauthorized access or disclosure. No method of transmission over the Internet or storage system is 100% secure, however, and we cannot guarantee absolute security.

8. Your Choices

  • Email preferences. You may opt out of non- transactional emails at any time by using the unsubscribe link in the email or by contacting us at info@azarcapitalgroup.com.
  • Do Not Track. The Site does not currently respond to "Do Not Track" browser signals.

9. Notice to California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights, subject to verification and applicable exceptions:

  • The right to know what categories of personal information we collect, the sources of that information, the purposes for which it is used, and the categories of third parties with whom it is shared
  • The right to request a copy of the specific pieces of personal information we have collected about you
  • The right to request correction of inaccurate personal information
  • The right to request deletion of personal information, subject to legal exceptions (including for information necessary to complete a transaction you requested)
  • The right to limit use of sensitive personal information
  • The right to opt out of the sale or sharing of personal information. We do not sell or share personal information as defined under the CPRA.
  • The right to non-discrimination for exercising your privacy rights

To exercise any of these rights, email info@azarcapitalgroup.com with "California Privacy Request" in the subject line. We may need to verify your identity before processing your request. You may designate an authorized agent to make a request on your behalf by providing written authorization and proof of identity.

10. Notice to Residents of the EEA, United Kingdom, and Switzerland

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation and equivalent local laws. These include the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing, as well as the right to lodge a complaint with a supervisory authority.

We rely on the following legal bases for processing: performance of a contract or pre-contractual steps at your request (to evaluate and service your loan inquiry); our legitimate interests in operating, improving, and securing the Site and communicating with you; your consent, where required; and compliance with legal obligations.

Our Services are operated from the United States. If you submit information from outside the United States, you acknowledge that your information will be transferred to, stored in, and processed in the United States, which may have data-protection laws different from those of your jurisdiction.

11. Children

The Services are not directed at children under 18 and we do not knowingly collect personal information from children under 18. If you believe we have collected information from a child under 18, please contact us and we will delete it.

12. Links to Other Sites

The Site may contain links to third-party websites or services. This Privacy Policy does not apply to those websites or services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third party you interact with.

13. Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and update the "Last updated" date above. Material changes will be announced through the Site or by other reasonable means. Your continued use of the Services after the effective date of any update constitutes your acceptance of the updated Policy.
