These Terms of Service ("Terms") govern your use of azarcapitalgroup.com (the "Site") and any loan-scenario or broker inquiry you submit through the Site (together, the "Services"). The Services are operated by Azar Capital Group LLC ("Azar Capital Group", "we", "us", or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
The Services are intended for real estate investors, developers, and licensed real estate brokers using them in the course of business. By using the Services, you represent that you are at least 18 years old, have the legal authority to enter into contracts on your own behalf and on behalf of any entity you represent, and are seeking financing for non-owner-occupied investment real estate only.
2. Not a Loan Application; No Commitment to Lend
Submitting a loan scenario or broker application through the Site is not a loan application, an offer to lend, a commitment to lend, or a pre-approval. All loans are subject to credit and collateral underwriting, satisfactory third-party reports (including appraisal, title, and insurance), issuance and acceptance of a written term sheet, and execution of binding loan documents. Rates, fees, terms, and loan-to-value ratios shown on the Site are indicative only and are subject to change without notice.
3. Investment Property Financing Only
We provide financing only for non-owner-occupied investment real estate. We do not provide financing for primary residences or for personal, family, or household purposes. By submitting a loan scenario, you represent that the requested financing is for an eligible investment property.
4. Accuracy of Information
You agree that any information you submit through the Site is complete, accurate, and not misleading. You understand that we rely on the information you provide in evaluating your inquiry and that misrepresentation may result in denial of financing, termination of an existing transaction, and potential civil or criminal liability.
5. Acceptable Use
You agree not to:
- Use the Services in violation of any law, regulation, or third-party right
- Submit false, misleading, fraudulent, or duplicate inquiries
- Attempt to probe, scan, or test the vulnerability of the Site or circumvent any security or access control
- Access the Site through automated means (including scrapers, bots, or headless browsers) except as expressly permitted by the Site's robots.txt
- Use the Site to transmit malware, spam, harassing content, or personal information of third parties without their consent
- Reproduce, redistribute, or create derivative works from Site content without our written permission
6. Intellectual Property
The Site and all content on it (including text, graphics, logos, images, loan-program descriptions, and Site design) are owned by or licensed to Azar Capital Group LLC and are protected by U.S. and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for the purpose of submitting a genuine inquiry.
7. Third-Party Services
The Site integrates with third-party services (including address autocomplete, hosting, email, and customer-relationship management platforms). Your use of those third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
8. Disclaimers
THE SITE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZAR CAPITAL GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AZAR CAPITAL GROUP OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (c) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR SUBMISSIONS OR CONTENT. OUR AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Azar Capital Group, its affiliates, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Site or Services; (b) your violation of these Terms; or (c) any content or information you submit through the Site.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any action arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and update the "Last updated" date above. Material changes will be announced through the Site or by other reasonable means. Your continued use of the Services after the effective date of any update constitutes your acceptance of the updated Terms.
13. Severability; Entire Agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and Disclosures, constitute the entire agreement between you and Azar Capital Group regarding your use of the Services and supersede all prior agreements on that subject.
